1.That the party of the first part shall act as a photography company and will provide the services and products related to photography shoot to its clients i.e. the party of the second part.
2.That at the time of booking the client shall communicate the location, venue and time of the shoot which is more specifically to be mentioned in Schedule A attached to the present covenant.
3.That the agreed venue and time of the shoot can be shifted on the request of the client if informed 48 hours prior to the shoot day. That the said shift will be as per the availability of the photographer of the company.
4.That the details of the photographer to conduct the shoot will be sent to the client by the company after the confirmed booking only.
5.That the client further agrees and understands that, unless otherwise specified in this Contract, client is not contracting for a personal service that will be performed by any specific photographer. The company may sub-contract or assign this contract to any shooter, photographer may assign any photographers associated with the photography company to perform its duties under this contract. All photographers must be capable and competent to perform the services in a workmanlike manner.
6.By making the booking customer is agreed to pay the amount mentioned in the booking
7.That the delivery of photographs on behalf of the company will only be made after the receipt of full and final consideration price of the shoot.
8.That the photography services provided by the Company only includes the delivery of the soft copy of the Digital Photographs only. If in case Client wants to get the hardcopy of the photographs or would like to get the Album created by the company than the same would be chargeable extra to the consideration price fixed.
9.That the Company will deliver the photos to the Client no more than thirty days (30 days) after the date of the Shoot.
10.That all Photos delivered to Client by the Company are licensed for Clients personal use only.
11.Any request of the client at the time of shoot over and above the agreed services between the company and the client during the booking, shall be communicated to the company. That the company is at sole liberty to decide on the said request and the decision of the company will be final.
12.That the Company agrees to maintain the data of shoots (i.e. photos and videos) for the period of 60 days from the date of delivery of the same to its clients. That the retrieval of the data after the delivery will be chargeable by the Company.
DISCLAIMER POLICIES
1.Except as expressly set forth in this agreement, In no event shall HoneymoonIQ i.e. the Company be liable for indirect, incidental or consequential losses or damages.
2.That the company and client agree that the photographer is under no obligation to capture any specific moment or pose or person(s) during the SHOOT.
3.We have no control over vis maior, extraordinary circumstances and weather conditions. Photo shoots could take place in any weather conditions since our Photographers are professionals and could suggest locations where it is possible to shoot in the rain etc. Sometimes rainy photo shoots are even more original, extraordinary and interesting than traditional “sunny days” photo shoots. However we will try to rearrange (with no guarantee) day and time of the photo shoot if there is bad forecast for the day of the photo shoot. Payment is not refundable because of the bad weather.
4.Client agrees to indemnify and hold harmless the Company for any liability, damage, or loss related to technological failure, including data loss.

6.Client agrees to hold Company/photographer harmless for any personal injury which may occur as the Client poses or works with Photographer.
7.That it is the duty of the client to obtain all necessary permissions for photographer to conduct the Shoot. That the Company/Photographer has no duty to obtain permission of reception centers, churches, buildings, properties, or other locations to operate thereon. Client understands and agrees that any failure to obtain these permissions resulting in fines to photographer, or which prevent photographer from photographing the event(s) is not the fault, liability, or responsibility of Photographer/Company.
8.That this agreement shall be governed by the law of state and all disputes regarding this agreement Shall be subject to the jurisdiction of Delhi Courts Only.
